Introduction

This Privacy Statement is a document to explain, how we process your personal information to enable us to carry out our work as covenant advisor.

This Statement describes in general terms how we collect and use personal information that was held by companies and or individuals before our appointment together with data collected during employer covenant review for the trustees and employer. Our legal obligation to process personal data arises from work we are required to carry out under insolvency and other related legislation.

It has been prepared to meet the requirements of the General Data Protection Regulation (GDPR), the Data Protection Act and any other national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK ('Data Protection Legislation').

Data Controller

Savants Covenant Advisory Limited is a limited company registered in England and Wales (the Company) whose principal activity is that of employer covenant review for trustees and employer. The sole Director of the Company is Mr. Adrian Duncan (Mr. Duncan). His and the Company's' registered and principal trading address and other contact details are given below. Mr Duncan is licensed to act as an insolvency practitioner in the United Kingdom by the Institute of Chartered Accountants in England and Wales.

As defined by data protection legislation, Mr. Duncan is Data Controller of personal data and the Company will act as Data Processor.

The data we may process

The personal data our covenant advisor may process will be basic details that may identify an individual and will typically be sufficient to allow us to carry out our work as covenant advisor, for example, conducting covenant reviews, clearance transactions and affordability reviews.

Why we process your personal information

Under the GDPR we control and/or process Personal Data electronically using the following lawful bases:

  • Legal obligation - to comply with the legal and regulatory obligations to which we are subject as a business.
  • Contract - to comply with our contractual duties to you.
  • Consent - where you have freely given consent at the time your personal data was provided to us.
  • Legitimate interests - to pursue the legitimate interests of our business including to provide our services,to develop or protect our business, or to keep people informed about relevant products and services. We are required to balance your interests against ours in the use of your data and we would not process your data where our interests are overridden by your own.

Data security and protection

We ensure the security of any Personal Data we hold by using secure data storage technologies and procedures in how we store, access and manage that information.

Your Personal Data is stored on secure, cloud-based servers located in the European Economic Area ('EEA').We may transfer data outside the UK and EEA to third parties who perform certain functions such as marketing to support the operation of our business, in which case we will ensure that all Personal Data is subject to sufficient protections and any such transfer is lawful. Marketing messages may contain mechanisms to track ‘click through’ activity. Any email marketing messages we send you will include a method to easily withdraw your consent (unsubscribe).

If in the future we intend to process your Personal Data for a purpose other than that for which it was collected we will provide you with information on that purpose and any other relevant information at that time.

We may also share personal data to lawfully assist the police or other law enforcement agencies or otherwise as permitted by the law.

How long we hold information

Personal data will be retained for as long as any legislative or regulatory requirement requires us to hold it. Typically, this may be up to 6 years after which it will be destroyed.

Your rights

You have the right to receive the information contained in this document about how your personal data may be processed by us.

You also have the right to know that we may be processing your personal data and, in most circumstances, to have information about the personal data of yours that we hold, and you can ask for certain other details such as what purpose we may process your data for and how long we will hold it.

Individuals have the right to request that incorrect or incomplete data is corrected and in certain circumstances, you may request that we erase any personal data on you which may be held or processed as part of our work as covenant advisor. You also have the right to lodge a complaint about any use of your information with the Information Commissioners Office (ICO), the UK data protection regulator.
